Unlike other states in Australia, Victoria does not have a prescribed form of contract that must be used for the sale and purchase of real estate, and whilst there used to be legislated general conditions in Victoria, they ceased to operate in 2018. Since then, contract conditions for the sale of real estate have become increasingly unfair with vendor’s solicitors and conveyancers effectively removing any rights a purchaser would otherwise have had.
In this competitive Victorian property market, we understand it’s not financially practical to pay for every contract and section 32 review, especially for first home buyers. The difficulty in reading a section 32 is that you must have regard to what documents it should contain, as much as what documents is does contain, something that generally only experience will allow you to do. For example, there is no requirement for a section 32 to contain information about illegal building works, only to disclose information about permits that have been granted in the last 7 years.
As such, when we review sale documents, we don’t just rely on the vendor’s disclosures, we take the time to review the property photos online and satellite images.

-Detailed review of the contract conditions, what they mean, and any that you should be cautious of.
-Detailed review of the section 32, what the property outgoings are, information about the title including any restrictions/covenants and easements, and zoning details including foreseeable obstacles if you intend to subdivide or factors that may affect your property insurance.
-Detailed review of any external sources of information including whether it appears building works have been carried out, and if there are any identifiable breaches of restrictive covenants or easements.
-If the property is within an owners corporation, we will advise of their current position (including any upcoming major works which may result in special fees and levies), and provide advice on any foreseeable risks.
