I HEREBY RETAIN ConveyancingX to perform conveyancing work as defined in Part 1 of the Conveyancers Act 2006 in connection with the transfer or conveyance of my property. ConveyancingX holds professional indemnity insurance under a compulsory master policy as per the Conveyancers Regulations for an amount not less than $2M.
AUTHORISE AND DIRECT ConveyancingX to prepare or arrange for the preparation of all relevant documents required and to sign any documents in connection with the conveyancing process not individually signed by me which is carried out in the course of conveyancing work.
AUTHORISE AND DIRECT ConveyancingX to prepare and submit the Foreign Resident Capital Gains and GST Withholding applications to the Australian Taxation Office AND FURTHER CONFIRM that all information provided to ConveyancingX is true and correct.
AUTHORISE AND APPOINT Jesse Roberts of ConveyancingX as our limited attorney to apply for and sign any stamp duty concession application, transferee or transferor statement required by the State Revenue Office of Victoria.
CONFIRM & ACKNOWLEDGE that if any actual or potential conflict of interest arises during a transaction, ConveyancingX must immediately disclose that conflict of interest to me.
CONFIRM & ACKNOWLEDGE any conveyancing advice between me and ConveyancingX is not for the benefit of a third party.
CONFIRM & ACKNOWLEDGE that to prevent cyber fraud, any email or attachment containing bank account details must be verified by telephone before transferring funds.
CONFIRM & ACKNOWLEDGE that if ConveyancingX is finalising our transaction on behalf of another conveyancer or solicitor, or we have otherwise been referred or recommended to ConveyancingX by another conveyancer, solicitor, mortgage broker or estate agent, ConveyancingX may, in some instances, share part of their charges with the referring party. ConveyancingX do not increase conveyancing fees cover the cost of any shared charges or referral fee paid.
CONFIRM & ACKNOWLEDGE that this disclosure statement relates to work done from our initial instructions and should I continue to provide ConveyancingX with instructions after receiving this agreement I am agreeing to be bound by it.

OUR CHARGES
The total of our charges inclusive of GST (as applicable) to represent you in respect of your transaction will be charged at the applicable following rate:
Sale or Purchase $1300.00; or
Related Party Transfer $920.00; or
Subdivision $920.00; or
Survivorship $350.00
including standard searches and certificates such as title and plan of subdivision searches, land information certificate, land tax clearance certificate, roads certificate, and water information statements, but does not include fees charged by Property Exchange Australia (PEXA) to conduct settlement electronically, or non-standard certificates and searches such as owners corporation certificates, planning agreements, covenants, caveats, building approvals, and further necessary disbursements as incurred by ConveyancingX on your behalf that could not reasonably be known at the time of providing you with the above rate.
Please note that this is an estimate only and is not to be taken as a tendering of our account. A tax invoice will be issued at or prior to settlement.
If after taking instructions from you, you wish to vary the terms of our agreement in respect of the work to be undertaken, or additional work is carried out which was not made known to us at the time of taking instructions, additional fees may apply at the rate of $220.00 per hour or part thereof.Â
If any of the parties to the transaction default in the terms of the contract, additional charges will occur to take the necessary steps to deal with the default.Â
PAYMENT OF OUR CHARGES
Immediately on request you shall pay such amounts as are required for costs and disbursements. Payment is required in two installments being half on upon completion of initial correspondence and receipt of tax invoice, and the balance on or before settlement of this matter & receipt of tax invoice.
Interim tax invoices may be necessary during the course of the transaction for additional work performed or out of pocket expenses incurred which could not have been contemplated at the time of signing this agreement or may be required as a result of you requesting us to undertake additional works after the signing of this agreement. Accounts are payable immediately.
Interest will be charged on our charges at a rate for the time being fixed under Section 2 of the Penalty Interest Rates Act 1983, from the period beginning 14 days after payment is demanded until our charges are paid.
All costs and expenses are payable at or prior to settlement. All charges and penalties are a charge on the land and if not finalised within 14 days after payment is demanded and at a last resort will be charged to the land and will incur a collection charge of $250.00 and interest on the unpaid amount.
In the event of a dispute in relation to costs you are able to make a complaint to the Director of Consumer Affairs Victoria under Part 6.2 of the Australian Consumer Law and Fair Trading Act 2012 or make an application to the Victorian Civil and Administrative Tribunal under Chapter 7 of the Australian Consumer Law and Fair Trading Act 2012.
RETENTION OF DOCUMENTS
On completion of our agreement we retain all documents in our possession a period of not less than seven (7) years after the date the final bill is rendered following which your file may be destroy. Titles and other security documents will be held indefinitely in safe custody until otherwise instructed in writing.
CONFIRMATION
I confirm this notice as agreement to retain ConveyancingX to act in relation to the conveyancing matter above upon the Terms and Conditions set out herein.

The Electronic Transactions (Victoria) Act 2000 establishes the regulatory framework for transactions to be completed electronically.
